These General Terms and Conditions of Sale (hereinafter the “Terms”) govern all sales concluded between the customer (hereinafter “you” or “the customer”) and L’Araignée Gypsie, a sole proprietorship represented by Stéphanie Bourgeois, via the website www.araigneegypsie.com hereinafter the “Site”), hosted on the Shopify platform.

1. PURPOSE

These Terms define the rights and obligations of the parties in the context of the online sale of handcrafted jewelry offered by L’Araignée Gypsie on its Site.

2. PRODUCTS

The products offered for sale are described and presented as accurately as possible. Photographs have no contractual value. As each piece is handmade, slight variations may exist between items.

3. PRICES

Prices displayed on the Site are expressed in euros (€), including all taxes (VAT), excluding shipping costs. L’Araignée Gypsie reserves the right to modify prices at any time without notice. The invoiced price is the one in effect at the time of order validation.

4. ORDERS

Placing an order implies full and complete acceptance of these Terms.

Order steps on the Site are as follows:

  • Selection of products and addition to the cart

  • Cart validation

  • Entry of delivery and billing information

  • Selection of shipping method

  • Secure payment

An order confirmation is sent by email. The sale is considered final upon acceptance of payment.

L’Araignée Gypsie reserves the right to refuse or cancel an order in the event of a dispute with the customer, non-payment, or suspected fraud.

5. PAYMENT

Payments are made using the methods offered on the Site (Stripe, bank cards, etc.). Payment is due in full at the time of order. Payment data is processed securely.

6. DELIVERY

Orders are carefully prepared and shipped within 3 to 7 business days, unless otherwise indicated (e.g. temporary shop closure). Deliveries are handled via La Poste (Lettre Suivie or Colissimo depending on country and order amount).

Delivery times are indicative and do not constitute a binding guarantee. L’Araignée Gypsie cannot be held responsible for delays beyond its control (strikes, customs, etc.).

7. RIGHT OF WITHDRAWAL

In accordance with Article L221-18 of the French Consumer Code, you have 14 calendar days from receipt of your order to exercise your right of withdrawal, without having to justify reasons or pay penalties.

The product must be returned in perfect condition, unworn, in its original packaging, at your expense. After inspection, a refund will be made within 14 days of receipt of the return.

Exceptions: personalised orders are neither refundable nor exchangeable, except in the event of a proven defect.

8. EXCHANGES & RETURNS

Exchanges are accepted within 14 days. Customers are advised to contact us in advance at contact@araigneegypsie.com

Return costs are the responsibility of the customer, except in the case of our error.

9. WARRANTY

Jewelry is guaranteed against manufacturing defects for a period of 6 months from the date of purchase. The warranty does not cover:

  • Normal wear and tear

  • Damage resulting from improper use, contact with water or chemicals

  • Impacts, twisting, or improper handling

In the event of a proven defect, the product will be repaired, replaced, or refunded.


10. PERSONAL DATA

Your personal data is collected and processed in accordance with our Privacy Policy and in compliance with the General Data Protection Regulation (GDPR). You may access, modify, or request the deletion of your data at any time.


11. INTELLECTUAL PROPERTY

All elements of the Site (texts, images, logos, visuals, design, etc.) are the exclusive property of L’Araignée Gypsie. Any reproduction, use, or exploitation without authorization is strictly prohibited.


12. LIABILITY

L’Araignée Gypsie cannot be held responsible for indirect damages related to the use of its products or misuse by the customer. In any case, L’Araignée Gypsie’s liability is limited to the amount of the order.


13. FORCE MAJEURE

L’Araignée Gypsie shall not be held liable for non-performance or delays caused by force majeure (natural disasters, armed conflict, pandemics, strikes, etc.).


14. GOVERNING LAW & DISPUTES

These Terms are governed by French law. In case of dispute, an amicable solution will be sought. Failing that, French courts shall have exclusive jurisdiction.
